2. Scope

These General Terms and Conditions of Sale apply to any order placed on www.jacker.fr by an individual consumer for non-professional purposes.


3. Products

The essential characteristics of the products are described on each product page.
Photographs are not contractually binding.


4. Prices

Prices are shown in euros, including all taxes, excluding delivery costs.
JACKER reserves the right to change its prices at any time, with products invoiced on the basis of the prices in effect at the time of ordering.

4.1 Customs duties and import taxes

For any order delivered outside the European Union, customs duties, import taxes, and customs clearance fees may be applied by the customs authorities of the destination country.

These charges are entirely the recipient’s responsibility and are not included in the sale price or shipping costs. We cannot predict their amount, as it depends on the local regulations in force in each country.

If the customer refuses to pay these charges and the parcel is returned, the return shipping costs, as well as any deduction of the initial shipping costs, may be charged to the customer.



5. Order

Any order implies full and complete acceptance of these General Terms and Conditions of Sale.
Validation of the order constitutes a signature and acceptance of the sales contract.
A confirmation email is sent to the customer after payment has been validated.


6. Payment

Payment is due immediately upon placing the order.
The accepted payment methods are indicated at the time of ordering.
Transactions are secured through the payment service providers used by JACKER.


7. Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the customer has fourteen (14) days from receipt of their order to exercise their right of withdrawal, without having to provide a reason.

To exercise this right, the customer may use the withdrawal button made available on the website www.jacker.fr, in accordance with the applicable regulations. The customer may also use the withdrawal form included in the appendix to these General Terms and Conditions of Sale or send any unambiguous statement expressing their wish to withdraw, in particular by email to shop@jacker.fr.

From the time the customer communicates their decision to withdraw, they have fourteen (14) days to return the products concerned.

The exercise of the right of withdrawal is subject to the following conditions:

  • the items must not have been worn;
  • the items must not have been washed, damaged, altered, or incomplete;
  • the items must not have been handled beyond what is necessary to establish their nature, characteristics, and proper functioning, in accordance with Article L221-23 of the French Consumer Code;
  • the items must be returned in packaging that ensures their protection during transport.

In accordance with Article L221-23 of the French Consumer Code, the customer may be held liable for any depreciation of the goods resulting from handling other than that necessary to establish their nature, characteristics, and proper functioning.

The customer is free to choose the carrier of their choice to return the products. Return shipping costs remain the customer’s responsibility, except in the event of an error attributable to JACKER or where otherwise required by law.

The customer is responsible for retaining any proof of shipment of the returned products, such as a deposit receipt or tracking number, in order to substantiate the shipment if necessary.

Subject to compliance with these terms and conditions, JACKER will refund the customer the price of the returned products as well as the standard delivery charges initially invoiced, using the same payment method as the one used for the order, unless the customer has expressly agreed to another refund method.

In accordance with Article L221-24 of the French Consumer Code, JACKER may defer the refund until the returned products have actually been recovered or until the customer provides proof of their shipment, the date used being the earlier of these two events.


8. Exceptions to the right of withdrawal

In accordance with the applicable regulations, the right of withdrawal does not apply in particular to:

  • personalized or made-to-order products,
  • unsealed socks and underwear for hygiene reasons.


9. Returns outside the right of withdrawal — commercial policy

Independently of the statutory right of withdrawal, JACKER offers a commercial return policy providing several resolution options.
This commercial policy is accessible through the dedicated “Returns and Exchanges” interface.

Under this framework, the customer may benefit, depending on the conditions specified when submitting the request, from several possible resolutions:
  • exchange (size or item),
  • refund,
  • or any other solution offered under the applicable commercial policy.

Terms:
  • maximum period of 30 days from receipt of the order,
  • items that have not been worn or washed and still have their original tags,
  • return shipping costs may be borne by the customer,
  • exact conditions specified when the request is approved.

This commercial policy is a goodwill gesture and does not replace the consumer’s statutory rights.


10. Discounted products and boxes

Under the commercial policy, outside the exercise of the right of withdrawal:

Discounted products may be subject to:
  • a size exchange,
  • a color exchange,
  • or a credit to be used on the website,

but do not qualify for a refund.

The statutory right of withdrawal provided for in Article 7 remains fully applicable, including to discounted products.

Boxes and Packs are neither exchangeable nor refundable under the commercial policy, except where the statutory warranties provided by law apply.


11. Statutory warranties

The customer benefits from the statutory warranties of conformity (Articles L217-3 to L217-20 of the French Consumer Code) and against hidden defects (Articles 1641 to 1649 of the French Civil Code).
In the event of a non-conforming product or a product affected by a hidden defect, the customer may contact shop@jacker.fr.


12. Personal data

Personal data is processed in accordance with the GDPR.
The Privacy Policy is available on the website.

13. Applicable law and dispute resolution

These General Terms and Conditions of Sale are governed by French law.
In the event of a dispute, the parties will endeavor to reach an amicable resolution.
In accordance with Article R631-3 of the French Consumer Code, consumer customers may bring proceedings before the court of their place of residence or the court of the place where the product was effectively delivered.
