GENERAL TERMS AND CONDITIONS OF SALE (GTC)

1. Identification

2. Scope of application

These general terms and conditions of sale apply to any order placed on the website www.jacker.fr by a private consumer, for non-professional purposes.

3. Products

The essential characteristics of the products are described on each product sheet.
Photos are non-contractual.

4. Price

Prices are indicated in euros, all taxes included (TTC), excluding delivery charges.

JACKER reserves the right to change its prices at any time, but products are billed based on the rates in effect at the time of the order.

5. Order

Any order implies full and unconditional acceptance of these GTC.
Order validation constitutes signature and acceptance of the sales contract.
A confirmation email is sent to the customer after payment validation.

6. Payment

Payment is due immediately upon ordering.
Accepted payment methods are indicated at the time of order (CB, Visa, Mastercard, etc.).
Transactions are secured through the payment providers used by JACKER.

7. Right of withdrawal

In accordance with Articles L221-18 and following of the Consumer Code, the customer has a period of 14 days from receipt of their order to exercise their right of withdrawal, without having to justify their decision.

To exercise this right, the customer must send an email to shop@jacker.fr, attaching the withdrawal form in the appendix or any clear statement expressing their intention to withdraw.

No withdrawal request can be processed via the customer interface.

The exercise of the right of withdrawal is subject to the following conditions:
  • the item(s) have not been worn, tried on, or washed,
  • the item(s) are strictly unopened, with their original packaging intact,
  • the customer returns the products in appropriate packaging.

The right of withdrawal must not be used to try on items.

In this context:
  • the customer is refunded for the returned product(s) as well as the initial standard delivery fees,
  • return shipping costs remain the responsibility of the customer (except for errors attributable to JACKER),
  • the refund is made via the same payment method used during the order, within 14 days after receipt and verification of the returned products.

8. Exceptions to the right of withdrawal

In accordance with regulations, the right of withdrawal does not apply notably to:
• personalized or made-to-order products,
• Socks and underwear unsealed (opened) for hygiene reasons.

9. Returns outside the right of withdrawal (commercial policy)

Outside the legal right of withdrawal, JACKER offers a commercial return policy allowing, under conditions, an exchange or credit.

This policy applies notably to the following cases:
  • Item tried on but not suitable (size, fit, etc.),
  • Request for size exchange,
  • Request for item exchange,
  • Request for store credit.

In this context:
  • No refund is made,
  • Only exchange or credit solutions can be offered,
  • Requests must be initiated via the customer interface, in the personal area, under “My orders”, then “Request a return”,
  • The detailed conditions (deadlines, product condition, practical modalities) are specified in the Return Policy available on the website.
The return policy outside the right of withdrawal is a commercial gesture from JACKER. It does not replace the consumer's legal rights, nor does it extend them.

10. Discounted products and boxes

Discounted products and boxes are neither exchangeable nor refundable in accordance with our commercial policy:
  • Discounted products are not eligible for JACKER's commercial return policy,
  • Discounted products are neither taken back nor exchanged,
  • No commercial return request for a discounted product can be processed through the customer interface.

11. Warranties

The customer benefits from the following legal warranties:
  • Warranty of conformity of goods, provided for in articles L217-3 to L217-20 of the Consumer Code.
  • Warranty against hidden defects, provided for in articles 1641 to 1649 of the Civil Code.

In case of a non-compliant product or one with a hidden defect, the customer is invited to contact customer service at shop@jacker.fr.

12. Personal Data

The customer's personal data is processed in compliance with applicable regulations, notably the GDPR.

For more information on data processing, the customer can consult the Privacy Policy available on the website.

13. Applicable law and dispute resolution

These general terms and conditions of sale are subject to French law.

In case of dispute, JACKER and the customer will strive to find an amicable solution.
Failing that, the court of Montpellier will have exclusive jurisdiction.
